A claim is generally against the driver at fault and their insurer, and sometimes against a trucking company, a vehicle owner or an employer.
What a claim covers depends on your injuries and losses, and on the law of the state where it happened.

Anyone injured in a collision they did not cause — drivers, passengers, motorcyclists, cyclists and pedestrians.
Unlike the other claim types on this site, this is a single-incident claim rather than one about a product used over years, so the deadlines are usually shorter and evidence disappears faster.
What helps a claim
You do not need any of this to talk to us — start with what you know and we will work out the rest. But these are the things that make a claim easier to evaluate, and they are worth gathering while you can.
- The date, time and location
- The police report or its number
- Photographs of the vehicles, the scene and your injuries
- Medical records from the emergency department onward
- Insurance details, yours and the other driver's
- Anything showing lost earnings
- Names of witnesses, if you have them

Then do not sign anything yet, and say so when we speak. An early offer arrives before anybody knows how your injuries will settle out, and accepting usually closes the claim for good.

That does not necessarily end a claim. Most states reduce what you can recover by your share of the blame rather than barring it entirely, and how that works varies. Tell us honestly what happened.
How quickly do I need to act?
Sooner than with the other claims on this site. Deadlines are usually shorter, and camera footage, vehicle data and witness memory all degrade in weeks.
What does it cost to ask?
